Arbitration and ADR

The Commission on International Arbitration operates as a forum for sharing of views and discussing questions in the field of international (commercial) arbitration and other forms of dispute resolution.

The Commission aims to:

• Formulate and suggest revisions of various ICC rules for dispute resolution, including the ICC Rules of Arbitration, the ICC Mediation Rules, the ICC Dispute Board Rules, and the ICC Rules for Expertise and other forms of dispute resolution,
• Examine legal and other aspects of arbitration and other forms of international dispute resolution, study them with regard to their current development and publish reports and guidelines on this basis,
• Promote settlement of international disputes on a worldwide scale the by means of alternative dispute resolution issued by International Chamber of Commerce.

Marek Prochazka is a founding Partner of PRK Partners specialising in corporate governance and dispute resolution (arbitration, mediation). Marek was educated in Switzerland and the United States before practicing in the Czech Republic. After graduating from the University of Bern, he worked in the Department of Banking Law in the university’s law faculty. Afterwards, he obtained a Master’s degree (LL.M.) from Georgetown University Law Center, in Washington D.C. Marek is an experienced lawyer with a longstanding practice, and his approach to resolving complex cases integrates various fields of law and other disciplines. Most of his cases involve international elements. Marek is the president of the Chamber of Commerce Switzerland – Czech Republic and a member of the Board of Directors of the Aspen Institute Central Europe o.p.s. He is an attorney at law of the Czech Bar Association, and he is also admitted in Switzerland, where he still practices on behalf of some Czech clients. Viktor Glatz is an attorney specialising in litigation, arbitration, execution and insolvency proceedings, and is a member of the litigation team at PRK Partners. He has experience with a number of cross-border court disputes and arbitrations. He also provides complex legal advice to clients in other areas, including corporate law or contract and obligation law. Viktor earned his Master’s (Mgr.) degree in law from the Faculty of Law of Charles University in Prague (2017). As part of his studies Viktor spent one semester at the University of Groningen in the Netherlands and underwent an internship in a prestigious law firm in London. Viktor has been with PRK Partners since 2014.

Jan Brodec is a partner of BRODEC & PARTNERS, attorneys-at-law, and a Senior Lecturer at the Commercial Law Department of Charles University Faculty of Law (field of specialisation - private international law and international commercial law). Jan Brodec is one of the leading lawyers and arbitrators in the Czech Republic. Petr Bříza is a partner of Bříza & Trubač, attorneys-at-law, and a Senior Lecturer at the Commercial Law Department of Charles University Faculty of Law. He often serves as an arbitrator and mediator (and as such is regularly mentioned by legal rankings), both in domestic and international disputes. Petr is sought out as an expert on private international law, EU law and cross-border litigation/arbitration in general.  JUDr. René Cienciala, LL.M., Urban & Hejduk s.r.o., advokátní kancelář

René Cienciala is a head of international practice at the law firm Urban & Hejduk. He previously worked in a leading Czech law firm for almost 10 years. He provides comprehensive legal advice to Czech and foreign clients in all stages of court proceedings as well as in domestic and international commercial arbitration (ICC, LCIA, VIAC or UNCITRAL). He likewise has an extensive experience in sports law as arbitrator before the Czech Football Association and as counsel in international sports arbitrations (CAS) or international disciplinary proceedings (UEFA). Furthermore, he specialises in protection of foreign direct investments and has acted as local counsel in investor-state arbitration (ICSID). He is active as arbitrator and in various professional associations (ICC Czech Republic, ICC YAF, YIAG and Young ICCA). He is alumnus of the leading Geneva LL.M. in International Dispute Settlement (MIDS 2018) and Charles University in Prague (Master of Laws 2013, Doctor of Laws 2017).  Mgr. Michal Čáp, LL.M., MCIArb, ROWAN LEGAL, advokátní kancelář s.r.o.

Michal Čáp is Associate/Attorney in law (2012) working with ROWAN LEGAL. Michal specializes himself on the field of international arbitration and dispute resolution. He successfully completed his LLM (Arbitration & Dispute Resolution) at the University of Hong Kong (2014). He acquired his first master’s degree (Mgr.) at the Law Faculty of the Charles University in Prague (2009). Michal is also a member of the Chartered Institute of Arbitrators (MCIArb). Michal Čáp has been listed in the Arbitration Future Leaders 2017 ranking, jointly organised by Who’s Who Legal and GAR (Global Arbitration Review). He has been listed as the only Czech in a non-partner’s position. Michal is included on the list of arbitrators of VIAC (Vienna) and is also a member of AFIA (Asia-Pacific Forum for International Arbitration). Jan Dobrý heads the dispute resolution practice at Clifford Chance's Prague office. Throughout his career, he has gained extensive experience in various forms of dispute resolution. He is actively involved in disputes before the Czech courts, the European Court of Justice, as well as disputes conducted in arbitration proceedings (both domestic and international), particularly in the areas of commercial, construction, and corporate disputes, with an increasing focus on disputes in the technology sector. Jan also provides advisory services in the field of administrative law and related judicial review of administrative decisions, both in competition law and in other highly regulated areas such as pharmaceuticals and energy. Jan is a graduate of the Faculty of Law at Masaryk University in Brno. During his studies, he also attended the University of Huddersfield in the United Kingdom, where, after two years of study at the Faculty of Economics and Administration of Masaryk University, he completed his economic education. Jan is an arbitrator of the Arbitration Court at the Prague Stock Exchange and a permanent representative of Clifford Chance at the Commission for Environment and Energy at ICC Czech Republic.

Miroslav Dubovský is Country Managing Partner of DLA Piper in Prague. During his 25 years of professional career, Miroslav has represented clients (including the Czech state) in numerous significant mediations and both domestic and international arbitrations relating to, among others, privatization of key state enterprises or investment protection under bilateral investment contracts. Miroslav has participated in over 250 arbitrations as a sole arbitrator, a member or as a chairman of arbitral tribunal in accordance with the rules of the ICC, the LCIA, the UNCITRAL, the VIAC, the Arbitration Court at the Chamber of Commerce and Agrarian Chamber of the Czech Republic and the Prague Stock Exchange Arbitration Court. Jan Havel is Partner at act Řanda Havel Legal advokátní kancelář s.r.o. Tomáš Hokr is an attorney at law and partner at Bříza & Trubač law firm. He specializes in the resolution of disputes with a strong cross-border / international component in court or in arbitration. Karolína Horáková is a partner in Skils s.r.o. advokátní kancelář in Prague. She specializes in international investor-state and commercial arbitration. She is a member of the ICC International Court of Arbitration. As counsel, she also represents clients before Czech courts. A graduate of Charles University, Prague (1991) and Pace University, New York (1990), she is admitted to the Czech Bar. Between 1999 and 2019 she was a partner of Weil, Gotshal & Manges LLP. Filip Hrazdira is an in-house lawyer at Československá obchodní banka, a.s. He graduated from the Law Faculty of the Charles University in Prague (Mgr., 2003). Before joining ČSOB, Filip worked in advocacy (registered as an attorney in 2008). In ČSOB, he leads a team of lawyers representing the bank in litigations and arbitration proceedings. Miloš Olík is the head of the dispute resolution desk at the ROWAN LEGAL law firm. Robert is a senior associate at Allen & Overy. He represents financial institutions and corporations in litigations and arbitrations, settlement negotiations and administrative proceedings. His experience in arbitration includes disputes from derivatives trades and other disputes in the financial sector, disputes from supplies of technical equipment, disputes in relation to insurance payments and disputes from unfair competition. Robert graduated from the Law Faculty of the Charles University in Prague in 2005. He regularly publishes and lectures as external lecturer at the law schools in Prague and Brno.

Rostislav Pekař is a partner in the Prague and Paris offices of Squire Patton Boggs. Rostislav’s main practice focus is international and domestic dispute resolution including investment arbitration, commercial arbitration and Czech litigation. He co-heads Squire’s global investment arbitration practice. Rostislav has represented his clients in more than 20 major international commercial arbitrations and more than 35 investment arbitrations. Some of his cases involved claims up to USD 8 billion. He appeared before all leading international arbitration institutions such as ICC, ICSID, VIAC, SCC and LCIA, and also has extensive experience with ad hoc arbitration under the UNCITRAL rules. Rostislav has been listed as a leading individual for dispute resolution in the Czech Republic in all major legal guides. For example, all annual editions of Chambers Global since 2012 rank Rostislav in Band 1 for arbitration work, describing him “an extremely knowledgeable, analytical adviser with a straightforward approach." Tomáš Richter graduated from Charles University Law School in 1994, received his LL.M. from the Central European University in 1996, and Ph.D. (2002) from the Masaryk University Law School. Between 2011 and 2014, he held the Chair in Cross-Border Corporate Insolvency Law at the Radboud University Nijmegen Law School. In 2018, he completed habilitation proceedings at the Prague School of Economics.
Tomáš qualified as advocate in 1998. From 1996 to 2004 he practiced at Allen & Overy in Prague, with secondments to London (1999) and Frankfurt (2002/2003). In 2005 he was partner at Noerr Stiefenhofer Lutz in Prague and from 2006 until 2021 of counsel at Clifford Chance in Prague. Since April 2021 he has been practicing at JŠK. He is arbitrator at the Prague Stock Exchange Arbitration Court and between 2004 and 2021 was arbitrator at the Arbitration Court of the Economic and Agrarian Chambers of the Czech Republic.
He specializes in corporate distress and insolvency and in resolution of disputes arising from them. He currently serves as the Chair of INSOL Europe's Academic Forum and member of the Board of Directors of the International Insolvency Institute. He also serves on the group of private experts with whom the EU Commission consulted on its proposals of the Recast European Insolvency Regulation 2015/848 and the EU Restructuring Directive 2019/1023.

Mgr. Dušan Sedláček, HAVEL & PARTNERS s.r.o., advokátní kancelář

Dušan Sedláček is an attorney-at-law and a partner at HAVEL & PARTNERS law firm (Prague), a registered mediator, and an arbitrator. He specialises in litigation and arbitration focusing on disputes arising from complex transactions and other complicated cases, further on mediation in commercial matters, and on insolvency proceedings and corporate restructurings. He is recommended as a leading Czech expert on dispute resolution and insolvency by the international publications Chambers & Partners and Legal 500.  JUDr. Martin Svatoš, Ph.D., mediator and arbitrator

Martin Svatos Ph.D., is one of the leading Czech mediators and arbitrators recognized by several international rankings (Who’s Who Legal 2016 Official Selection for Czech Republic, Mediator of the Year 2016, the exclusive winner from Czech Republic by Wealth and Finance INTL). As a mediator, he has conducted more than 150 both international and domestic commercial disputes (construction law, IT, transport, energy law,…). He is a member of the board of the Czech Commodity Exchange Arbitration Court. Further, he has acted in several ad hoc and institutional arbitration both as an arbitrator and as an external legal counsel (ICC, Ad hoc, Arbitration court of Czech Football Association,…).

In addition to his rich dispute resolution experiences, he teaches at the Charles University in Prague and several other universities all around the globe (Georgetown University - USA, Università degli studi di Urbino Carlo Bo - Italy, Université des Antilles na Guadeloupe, Shanghai University of Finance and Economics - PRC...).  JUDr. Barbora Šnáblová, LL.M., BARBORA ŠNÁBLOVÁ advokátní kancelář s.r.o.

Since 2015, Barbora has acted as partner of a boutique law firm specializing in dispute resolution, in particular on the international plane. She has extensive experiences in the area of international investment arbitration, representing both investors and respondent states. She is furthter involved in commercial arbitration, and she has represented trade companies in disputes maintained under the ICC Rules. Barbora obtained her LL.M. degree in the London School of Economics and Political Science, and she has been an attorney-at-law since 2007. She worked for several international law firms. Barbora speaks English and German. Andreas Ueltzhöffer is a member of the Czech Bar as well as of the German and Slovak Bar and has been practicing as an attorney in the Czech Republic since 1994 and in Slovakia since the founding of UEPA advokáti s.r.o. in Bratislava. For many years of his professional career he worked as a partner in international law firms in Prague, such as CMS Cameron McKenna. He advised on numerous large and medium sized M&A and real estate transactions, advising both foreign investors on their investment projects in the Czech Republic and Czech investors on investment projects abroad.

Besides transactional work Andreas also puts a strong focus on arbitration and alternative dispute resolution and has been involved in a number of high-value proceedings, both as party representative and as arbitrator. In 2016 he successfully concluded as chairman of the tribunal an ICC arbitration with a volume of over EUR 1 bln within ten months of his nomination. Andreas lectures at the University of Economics in Prague (VŠE), being as well a member of the Scientific Advisory Board of its Faculty of Business Administration. Andreas is a German native speaker and fluent in English and Czech.

Mgr. Lukáš Vacek, Aegis Law, advokátní kancelář, s.r.o.

Lukáš is an attorney-at-law focusing on dispute resolution and he represents clients both before courts and in international arbitration. Lukáš has extensive experience in complex cases and has been involved in representing Czech and multinational clients in disputes worth over one billion crowns. He specializes in shareholder disputes, bill of exchange disputes and construction disputes. Internationally, Lukáš has represented clients in international arbitrations before foreign arbitral tribunals such as the London Court of International Arbitration (LCIA). Lukáš graduated from the Faculty of Law of Charles University in Prague and speaks fluent English in addition to Czech.
